Jones Civil Asset Forfeiture Rights Bill Clears Committee

HARRISBURG – Legislation by Rep. Tom Jones (R-Lancaster/Lebanon) to inform individuals of their rights regarding civil asset forfeiture was approved unanimously by the House Judiciary Committee and will now be considered by the full House.
“Advancing this bill is a statement in ensuring people involved in situations where assets were seized by law enforcement know their rights,” Jones said. “This bill will also strengthen accountability in the use of civil asset forfeiture.”
Currently, law enforcement agencies may seize an individual’s money or personal property without first filing criminal charges or securing a conviction. While the Commonwealth must demonstrate a connection between seized property and criminal activity, in many cases the owners of such assets are forced to navigate a complex legal process. This often includes long waiting periods when challenging a seizure in court. In fact, some property owners are forced to wait months, sometimes years, before stepping foot inside a courtroom.
Jones’ House Bill 2273 would require law enforcement agencies to provide an individual with clear, written notice of their rights under our law when property is seized.
“This legislation protects our constituents from unlawful seizures and ensures they are provided with the information and materials they need to challenge such seizures,” Jones said. “It is also a balanced and constructive approach to addressing seized asset issues that have existed for years.”
